Terms & Conditions (AGB)
1. Scope and Provider
These Terms and Conditions apply to all contracts for the purchase of digital products and services ("The Ring Thing") concluded between Maximilian Mühlhoff (hereinafter referred to as the "Provider") and the customer via this website.
2. Subject Matter of the Contract
The Provider operates a digital consultation service in the form of an interactive assessment that helps buyers create a technical briefing for engagement rings.
Tier 1: An automatically generated, digital PDF document ("Blueprint").
Tier 2: The digital PDF document, plus a personal video review by an expert.
The Provider is explicitly not a jewelry manufacturer or retailer. The Provider does not hold inventory, does not sell physical rings, does not act as a marketplace, and does not dictate or appraise diamond prices.
3. Conclusion of Contract and Payment The contract is concluded as soon as the customer completes the checkout process and the payment is successfully authorized via our payment processor, Stripe. All stated prices (e.g., in Euros) are final prices.
4. Delivery and Provision
Digital PDF (Tier 1 & 2): The "Blueprint" is generated automatically upon completion of the questionnaire and payment. It is delivered to the customer immediately via email or download link.
Video Review (Tier 2): The personal video review will be delivered to the customer digitally within a maximum of three (3) business days after the generation of the PDF.
5. Statutory Right of Withdrawal and Voluntary Guarantee
Waiver of Statutory Right of Withdrawal: Because the product is a digital download delivered immediately, the customer expressly agrees during checkout that the Provider will begin executing the contract before the statutory withdrawal period expires. By granting this consent, the customer acknowledges the loss of their statutory right of withdrawal once the download or email delivery begins.
Voluntary 7-Day Money-Back Guarantee: Irrespective of the waived statutory right of withdrawal, the Provider offers a voluntary 7-day refund policy. If the customer is not satisfied with the resulting "Blueprint", they may request a full refund within 7 days of the purchase date by emailing support, without needing to provide a reason.
6. Limitation of Liability
The "Blueprint" serves exclusively as an advisory and informational tool for the customer.
The Provider accepts no liability for whether a third-party jeweler can, or is willing to, technically execute the design proposed in the PDF.
The Provider accepts no liability for the accuracy of the ring size provided by the customer or any resulting fit issues.
The Provider makes no binding price guarantees for gemstones or metals on the open market and does not dictate diamond prices.
The Provider is only liable for intent and gross negligence. Liability for simple negligence is strictly limited to the purchase price of the digital product.
7. Copyright and Rights of Use
All rights to the questionnaire, the underlying logic, and the website design remain with the Provider. Upon purchase of the "Blueprint", the customer is granted a simple, non-transferable, and non-commercial right to use the generated PDF document. Commercial resale or distribution of the document is strictly prohibited.
8. Final Provisions and Jurisdiction
Swiss law applies to these Terms and Conditions, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection regulations in the customer's country of residence (e.g., within the EU) provide broader protection. The place of jurisdiction for all disputes is the Provider's registered seat in Switzerland, provided the customer is not a consumer.
